Asylum & Protection

Successful Grant of Refugee Status After Initial Refusal

Client from Afghanistan, referred to us following a refused asylum application by the Home Office

Our client had fled serious harm in Afghanistan but their initial asylum application had been refused by the Home Office without proper consideration of the country guidance. They came to us facing removal directions and a pressing appeal deadline.

We obtained the full refusal letter and previous representations, identified several errors in the Home Office's assessment, and built a comprehensive appeal bundle with expert country evidence, medical evidence, and detailed witness statements covering all aspects of the client's account.

At the First-tier Tribunal hearing, the judge accepted the client's credibility in full and found they met the refugee definition under the Refugee Convention.

Outcome

Refugee status granted on appeal. Client now has five years' leave to remain with a pathway to indefinite leave to remain and eventual British citizenship.

Family Visa

Partner Visa Approved Following Prior Refusal on Relationship Grounds

Settled British citizen seeking to bring their non-EEA partner to the UK

A British citizen client came to us after a partner visa application had been refused on the basis that the Entry Clearance Officer was not satisfied the relationship was genuine and subsisting. The couple had substantial evidence of their relationship but it had not been presented effectively.

We advised on the correct format and structure of the application, drafted a detailed covering letter addressing the refusal reasons point by point, and helped gather additional documentary evidence including call logs, joint financial records, photographs, and supporting witness letters.

Outcome

Partner visa granted on the reconsideration application without need to appeal. The couple were reunited within three months of instructing us.

Naturalisation

British Citizenship by Naturalisation — Complex Continuous Residence Case

Long-term UK resident with absences that required careful calculation and explanation

Our client had lived in the UK for over twelve years on various immigration statuses and held indefinite leave to remain. They wished to apply for British citizenship but had numerous absences from the UK over the qualifying period and were concerned that some of these might have broken the continuity of residence requirement.

We conducted a detailed audit of all travel dates, calculated absences precisely against the statutory requirements, and prepared a detailed schedule explaining each absence. Where absences were attributable to Crown service or unavoidable circumstances, we set this out clearly with supporting evidence.

Outcome

Naturalisation as a British citizen approved. Our client attended their citizenship ceremony and received their British passport within the standard processing time.

Skilled Worker Visa

Skilled Worker Visa — Switching from Student Visa in the UK

International student completing their studies and switching to a Skilled Worker visa with a confirmed job offer

A client who had studied in the UK on a Student visa was offered a skilled position by a licensed sponsor employer. The offer met the salary threshold requirements introduced in April 2024, but the client was concerned about the timing of their application relative to the expiry of their student leave and the graduation ceremony.

We advised on the 3C leave provisions, the correct timing for the in-country switch application, and prepared a full Skilled Worker application including the CoS assignment, salary evidence, English language, and maintenance requirements.

Outcome

Skilled Worker visa approved within standard processing time. Our client commenced their new role lawfully and began accruing qualifying residence toward ILR under the five-year settlement route.

Immigration Appeals

Successful Upper Tribunal Appeal — Error of Law by First-tier Tribunal

Client whose First-tier Tribunal appeal had been dismissed on incorrect legal basis

Our client's appeal had been dismissed by the First-tier Tribunal on grounds that did not properly apply the relevant case law on Article 8 ECHR private life. The judge had failed to conduct the proportionality assessment correctly and had not adequately reasoned their decision.

We drafted grounds of appeal to the Upper Tribunal identifying the specific error of law, supported by authorities from the Court of Appeal. Permission was granted, and at the Upper Tribunal hearing the error of law was conceded by SSHD counsel. The Upper Tribunal set aside the First-tier decision and remade it in our client's favour.

Outcome

Appeal allowed by the Upper Tribunal. Leave to remain granted on human rights grounds. The client, who had been in the UK for many years, was able to regularise their status and apply for ILR at the appropriate juncture.

EU Settlement Scheme

Late EUSS Application Accepted — Reasonable Grounds Established

EU national who missed the 30 June 2021 EUSS deadline through no fault of their own

Our client, an EU national who had been living in the UK since 2013, had not applied to the EU Settlement Scheme before the 30 June 2021 deadline because they were not aware of the requirement. They discovered they had no lawful basis to remain when they tried to change employment.

We advised on the late application process, established reasonable grounds by reference to Home Office guidance, prepared supporting evidence of continuous UK residence since before the deadline, and managed the correspondence with the EUSS team throughout.

Outcome

Late EUSS application accepted on reasonable grounds. Settled status (indefinite leave to enter under Appendix EU) granted, reflecting the client's over five years of continuous UK residence.
